Legal basis: It concerns Articles 1 (the right to work), 11 (the right to protection of health), 30 (the right to protection against poverty and social exclusion), 31 (the right to housing) and E (non-discrimination) in conjunction with the aforementioned provisions of the revised European Social Charter.

SubjectFEANTSA and FIDH allege that the absence of specific legal or regulatory provisions to regulate the increasing number of ordinances in France repressing behaviour commonly adopted by homeless people in the public space demonstrates that the national legal framework is not protective of homeless people and entails a violation of the aforementioned provisions of the Charter. 

The European Committee of Social Rights declared the complaint admissible on 17 October 2023.
