New Report by Radboud Law Clinic Highlights Criminalisation of Homelessness in the Netherlands

The Radboud Law Clinic has published a compelling legal analysis for the Straat Consulaat entitled “Stigmatisation and Criminalisation of Homelessness through Regulation and Policy.” This report sheds light on how certain laws and regulations in the Netherlands contribute to the stigmatisation and criminalisation of people experiencing homelessness.

Grounded in a human rights framework, the report provides an in-depth legal assessment based on the Netherlands’ obligations under international human rights law, particularly those stemming from the United Nations. It offers a critical tool for national and local authorities to examine and revise existing policies that may inadvertently infringe on the rights and dignity of homeless individuals.

This analysis underlines the urgent need for a rights-based approach in addressing homelessness, one that refrains from punitive measures and instead promotes inclusion, support, and adequate housing.
