Legal basis: Infringement of Article 6 - Right to a fair trial (Article 6)
Subject: These cases concern foreign nationals who had been refused asylum and were without accommodation at the time of the events. At their request, the interim relief judge of the Toulouse Administrative Court (hereinafter the Administrative Court) ordered the State to provide them with emergency accommodation. Invoking Article 6 § 1 of the Convention, the applicants complained that the administration had failed to comply with the interim relief judge's orders.
Decision:
The Court holds that there has been a violation of Article 6 § 1 of the Convention;
(a) holds that the respondent State must pay to the household of S.A. and to the household of A.C. respectively the sum of EUR 5,000 (five thousand euros) within three months, plus any amount that may be due on that sum by way of tax, for non-pecuniary damage;
b) holds that from the expiry of the said period until payment, this amount shall be increased by simple interest at a rate equal to that of the marginal lending facility of the European Central Bank applicable during that period, increased by three percentage points;
