The Bulgarian constitution does not recognize the right to housing as a fundamental right. Bulgaria has ratified the Revised European Social Charter although it has not ratified Charter Article 31, which provides for the right to housing. However, Bulgaria has ratified the Additional Protocol providing for a Collective Complaint procedure.
Collective Complaints:
Several collective complaints have been initiated against Bulgaria concerning the treatment of Roma. These include:
- European Roma Rights Centre v. Bulgaria (No. 48/2008) challenged the adequacy of Bulgaria’s provision of social assistance;
- European Roma Rights Centre v. Bulgaria (No. 46/2007) challenged the inadequate provision of medical services to Roma populations in Bulgaria;
- European Roma Rights Center (ERRC) v. Bulgaria (No. 31/2005) rendered an unfavorable ruling by the Council against Bulgaria’s inadequate provision of housing to Roma families.
However, there are currently no Collective Complaints under examination against Bulgaria.
