Legal basis:

The European Court of Human Rights has, by a majority, declared the application inadmissible. The case was brought by Ms AMB, who was due to be evicted from an apartment she occupied illegally along with two minor children. On application, ECtHR granted an interim measure under Rule 39 of the Rules of the Court, suspending the eviction. As directed, the Spanish Government provided the Court with supporting factual information to justify the lifting of the interim measure. This Spanish Government brought to the Court’s attention various safeguards the administration had in place, which Ms AMB could avail of should she find herself and her children homeless. These included assistance from the Madrid Institute for Minors and the Family, and Social Services, the latter able to provide her with immediate temporary accommodation until such time as a permanent solution was found.
