Subject:
The ERTF alleges that the situation in France amounts to a violation of several rights of the Charter because of:
 
  • the exclusion from compulsory schooling of Roma children and adolescents as a result of the permanent instability of the settlements and their living conditions;
  • administrative, social and economic discrimination;
  • housing conditions that do not respect the human dignity and the basic needs of children;
  • successive evacuations preventing any inclusion in the social fabric and any staying in school.

In its decision on the merits, the Committee concluded there is:
  • there is a violation of Article 17§2 of the Charter;
  • there is a Violation of Article E taken in conjunction with Article 10§§3 and 5 of the Charter,
  • there is a Violation of Article E taken in conjunction with Article 17§2 of the Charter;
  • there is a Violation of Article E taken in conjunction with Article 31 (right to housing) of the Charter;
  • there is a violation of Article E taken in conjunction with Article 30 (right to protection against poverty and social exclusion) of the Charter.
