Human Rights and Horizontal effect - how can human rights be used to help tenants/occupiers in the private rented/mortgage sector? Insights from and discussions with European colleagues.
Eligibility for social assistance and free movement of persons – the EU Commission is looking at the UK’s Right to Reside test whilst the UK wants to extend discrimination against EEA nationals to include state benefits paid to those in work. We will look at the European position generally and what the future holds for equal treatment as regards access to social assistance in the EU?
Positive obligations – using jurisprudence from international and national courts, international treaty bodies, and the EU to strengthen access to accommodation for homeless people. Illustrative examples from the response to trafficking to be given. Learning from the UK’s legislative context and filling the gaps.
